PROMOTION DESCRIPTION: McDonald's® Happy Meal® Chef Contest (the "Promotion" or the "Contest") begins on March 5, 2012 at 12:01:00 AM Central Time (CT) and ends April 18, 2012 at 11:59:59 PM CT (the "Contest Entry Period"). By participating in the Contest, each entrant (the "Participant") unconditionally accepts and agrees by submitting an entry to comply with and abide by these Official Rules and the decisions of McDonald's USA, LLC (the "Sponsor"), which shall be final and binding in all respects.
PROMOTION ELIGIBILITY: The Promotion is open only to residents of the 50 United States and D.C. who are eighteen (18) years of age or older at the time of entry and a parent or guardian with a child eight (8) to eleven (11) years of age at the time entry, both parent or guardian and child must have a valid passport prior to travel and both parent or guardian and child are able to travel internationally. Persons in any of the following categories are NOT eligible to participate or win prizes in the Contest: (a) any person who on or after September 1, 2011 was or is a McDonald's restaurant franchise owner or employee or a director, officer, employee, agent, or independent contractor of: Sponsor; any of their respective parent companies, subsidiaries, affiliated companies or service agencies; and any entities retained by Sponsor for the administration of the Promotion; (b) individuals who are engaged in the development, production or distribution of Promotion materials or the prize supply for the Contest including the London Organizing Committee of the Olympic Games and Paralympic Games Limited (LOCOG), the International Olympic Committee (IOC) and the United States Olympic Committee (USOC); and (c) persons who are immediate family members (defined as spouse, IRS dependent, or biological, adoptive or step- mother, father, sister, brother, daughter or son, and each of their respective spouses) of, or who reside in the same household as, any person in any of the preceding categories. HOW TO PARTICIPATE IN CONTEST: Go online to happymealchefs.mcdonalds.com (the "Website") and proceed to the Contest entry page where you will be required to complete an online registration form with all required information about you.
- Basic Information: You will be prompted to enter your date of birth, first name, last name, e-mail address, home address, state, city, zip code, your child’s first name and date of birth, check the box to agree to and accept the terms of the Official Rules (the "Registration").
- Questionnaire: Next, you will be asked to answer 3 questions with your child about family meal time and nutrition using the USDA’s My Plate guidelines provided on the Website or found at www.choosemyplate.gov. ("Questionnaire".)
- Video: Next, you will be asked to upload an original video of you and your child that shows how you make family meal time fun and nutritious. The video cannot exceed 3 minutes in length and must be in AVI, MOV, MPEG/MPG, MP4, or MOV format.
- Review: Review your information, questionnaire responses and video (collectively, "Submission") and follow the instructions to make any changes.
- Accept Official Rules: Once you have reviewed your Submission content, you will be asked to read and accept the terms of these Official Rules. In order for your Submission to be valid, and for you to be entered into the Contest, you must check the box on the Submission Review page accepting these Official Rules. If you have completed all of the preceding steps, a "thank you for entering" page will be shown to confirm that your entry has been accepted.
All Submissions can not be about or contain:
- Violent or negative of any ethnic, racial, gender, religious, professional or age group, profane or obscene;
- The use of alcohol, illegal drugs, tobacco, firearms/weapons, any activities that may appear unsafe or dangerous, or any particular political agenda or message;
- Offensive or be about hate; Submission cannot defame, misrepresent or contain negative remarks about Sponsor or its products, or other people, products or companies;
- Trademarks, logos or trade dress owned by others or advertise or promote any brand or product of any kind, without permission, or contain any personal identification, such as license plate numbers, e-mail addresses or street addresses;
- Copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media or musical "samples") without permission;
- Materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, other than Participant, without permission;
- Communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate;
- Depict, and cannot itself, be in violation of any law.
By providing a Submission, each Participant assigns transfers and conveys all right, title and interest in and to the Submission to Sponsor. Sponsor and its agents shall have the right, among others, to sell, copy, publish, distribute, perform, transmit, display, use, adapt, edit, modify or otherwise use the Submission throughout the world in perpetuity in any way, in whole or in part, in commerce and in any and all media now known or hereinafter developed, without limitation and without further consideration, compensation or notice to the Participant. Participant also grants Sponsor the irrevocable, unrestricted worldwide right to use, publish, display, broadcast and distribute materials bearing Participant’s name, voice, image, likeness and/or any other identifiable representation of Participant, including, but not limited to, statements attributable to Participant ("Participant’s Likeness"), Participant agrees that all materials containing Participant’s Likeness shall be and remain the sole and exclusive property of Sponsor, and Participant hereby assigns any and all rights in or to such material to Sponsor and releases and forever discharges Sponsor from any and all claims, liabilities and damages relating to the use of Participant’s Likeness. Participant hereby waives any and all rights to inspect or approve Sponsor’s use of the Submission or Participant’s Likeness, or any part or element thereof. By providing a Submission to Sponsor, Participant warrants and represents that the Submission: (a) is their original work, (b) has not been previously published, (c) has not won previous awards, (d) does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; (e) that they have obtained permission from a person (or such person’s parent or legal guardian if the person is a minor), whose name, image, likeness or voice is used in the Submission, and (f) that publication of the Submission on the Internet or other media will not infringe the rights of any third party. Participant will indemnify and hold harmless Sponsor and its officers, directors, employees, agents, franchisees, subsidiaries, affiliates, divisions and representatives, against all claims, demands, suits, or other proceedings, and all resulting loss, damage, liability, cost, and expense (including reasonable attorneys’ fees), made by any third party due to or arising out of: (a) the Submission; (b) Participant’s violation of these Official Rules; or (c) Participant’s violation of any rights of any third party. Sponsor reserves and Participant grants to Sponsor the right to assume the exclusive defense and control of any matter subject to indemnification by Participant.
SUBMISSIONS ARE THE VIEWS/OPINIONS OF THE INDIVIDUAL PARTICIPANT AND DO NOT REFLECT THE VIEWS OF SPONSOR IN ANY MANNER. As such, Participant may be held personally liable for the Submission if it is defamatory or libelous of specific individuals or any other company or if it otherwise violates the rights of any other person or entity. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to Participants. By providing a Submission, Participant agrees that the Submission is gratuitous and made without restriction, will not place Sponsor under any obligation to use the Submission, and Sponsor is free to disclose the Submission on a non-confidential basis to anyone or otherwise use the Submission without any additional compensation to you. Participant acknowledges that Sponsor and its various departments, franchisees, affiliates, divisions, subsidiaries, agencies and representatives continually test and evaluate various ideas, concepts, designs, products and other materials for use in connection with Sponsor’s business and it is possible that some person or entity within Sponsor’s system is currently using, evaluating and/or testing an idea, concept, design and/or product that is similar or identical to any of the ideas, concepts, designs, products and/or other information contained in the Submission. Participant acknowledges and agrees that it has no claims, and hereby waives any and all claims, against Sponsor, its officers, directors, employees, agents, franchisees, subsidiaries, affiliates, divisions and representatives in connection with Sponsor’s consideration, use or development of any similar or identical idea, concept, design, product or other information now or in the future. In addition, Participant hereby irrevocably releases Sponsor, its officers, directors, employees, agents, franchisees, subsidiaries, affiliates, divisions and representatives from any and all liability, claims, demands, losses, damages, costs or expenses (including, without limitation, attorneys’ fees and costs) arising out of or in any way related to Participant’s participation in the Contest. Sponsor reserves the right to remove, reject or disqualify (along with the Participants who submitted them) any Submissions which, in its opinion or the opinion of the independent qualified official judges ("Contest Judges"), violate any of these Official Rules or are otherwise inappropriate for inclusion on the Website. Sponsor further reserves the right to remove and disqualify (along with the Participant who submitted it) any posted Submission if Sponsor determines in its sole and absolute discretion, after the Submission has been posted, that the Participant has violated these Official Rules or the policies, terms or conditions of the Website in any way.
CONTEST JUDGING: At the conclusion of the Contest Entry Period, the Contest Judges will select twenty (20) potential Finalists and ten (10) alternates based on the following judging criteria:
- Creativity/Originality: 20%
- Use of the USDA’s My Plate guidelines: 20%
- Clarity of Expression: 20%
- Amicable /Personality: 10%
- Appropriateness to theme: 10%
- Teamwork between parent/legal guardian and child: 10%

In the unlikely event of a tie, the tied Participant with the highest score in Criterion A. Creativity/Originality will be deemed the potential Finalist. If additional tie breakers are needed, the tie-breaking mechanism will be used; however, instead of the highest score in Criterion A. determining the potential Finalists from among the tied entries, the highest scores in each of Criteria B. through G., in sequence (to the extent needed) will determine the potential Finalists.
During the Contest Entry Period selected Submissions may be posted at Sponsor’s sole discretion, in whole or in part, on the Website. Such postings, if they occur, may be on a rotating or occasional basis and may be discontinued at any time at Sponsor’s sole discretion. POSTING OF A SUBMISSION OR PORTION THEREOF DURING THE CONTEST ENTRY PERIOD IS NOT MEANT TO INDICATE THAT THE SUBMISSION IS A POTENTIAL FINALIST OR A POTENTIAL WINNER IN THE CONTEST, OR THAT THE SUBMISSION IS OTHERWISE FAVORED IN ANY WAY. FINAL DETERMINATION OF GRAND PRIZE WINNERS: Following the conclusion of the Contest Entry Period the Contest Judges will declare twenty (20) Finalists and (10) alternates who will then be subject to a final round of judging based upon the same criteria noted above by a panel which could include educators, health and nutrition experts, and/or Olympic Athletes. At the conclusion of that final round of judging ten (10) 2012 London Grand Prize winners, two (2) of which will also be Happy Meal Chef Grand Prize Winners and five (5) alternates will be determined, subject to verification of eligibility and compliance with these Official Rules. The Finalists with the top score will be determined the Happy Meal Chef Grand Prize Winners. In the event of a tie, the tied Finalist with the highest score in Criterion A. Creativity/Originality in the initial judging phase will be declared one of the Grand Prize Winners. If additional tie breakers are needed, the tie-breaking mechanism above will be used; however, instead of the highest score in Criterion A. determining the potential Grand Prize Winner from among the tied Finalists, the highest scores in each of Criteria B. through G., in sequence (to the extent needed) will determine the potential Grand Prize Winner. Status as a Grand Prize Winner will be subject to verification of eligibility and compliance with these Official Rules.

- GRAND PRIZE: Ten (10) Grand Prizes are available for a trip for two (2) people for four (4) days and three (3) nights which could occur on any consecutive day between from July 27, 2012 through August 3, 2012 as defined by the Sponsor to the London 2012 Olympic Games and the opportunity for the winner to be one (1) of two (2) McDonald’s Happy Meal Chefs. Each Prize includes: round-trip, coach class air transportation for the winner and the child named in the Registration from the major United States gateway city airport closest to the winner's residence (as determined by Sponsor) to London, England; ground transportation to and from airport to hotel and official Contest events; London 2012 Olympic Games event tickets to at least two (2) London 2012 Olympic Games events to be determined solely by Sponsor; standard double occupancy hotel accommodations for four (4) days and three (3) nights. Winners and their child must be able to travel on the specified dates or prize will be forfeited in its entirety. Total ARV of each Grand Prize: $5,000. Total combined ARV of all Grand Prizes: $50,000. All income tax, gratuities, personal expenses, and all other expenses incurred in association with acceptance of such prize that are not specifically provided for herein, including but not limited to, gratuities, meals and any other incidental expenses, are solely the responsibility of the applicable prize winner and his or her guests. HAPPY MEAL CHEF EXPERIENCE GRAND PRIZE: Two (2) Happy Meal Chef Grand Prizes are available and include the following:
Grand Prize addition: The opportunity to participate in the McDonald’s Global Food Challenge event in London, England representing the United States on or about July 25, 2012 which will include an additional (2) days and one (1) night standard double occupancy hotel accommodations for two and ground transportation to and from hotel and official Contest events. Winners and their child must be able to travel on the specified dates or prize will be forfeited.
McDonald’s Headquarters Trip: Trip for two (2) for (2) days and (1) night which could occur on any consecutive days as determined by Sponsor between from September 1, 2012 through August 31, 2013 to Oak Brook, IL to visit the McDonald’s Corporate Offices. Each Prize includes for the winner and the child named in the Registration round-trip, coach class air transportation for the winner and the child named in the Registration from the major United States gateway city airport closest to the winner's residence (as determined by Sponsor) to Chicago, Illinois ground transportation to and from airport to hotel and official Contest events; standard double occupancy hotel accommodations. Winner and their child must be able to travel on the dates specified by the Sponsor between from September 1, 2012 through August 31, 2013 or prize will be forfeited in its entirety.
Total ARV of each Happy Meal Chef Grand Prize: $2,500 Total combined ARV of all Happy Meal Chef Grand Prizes: $5,000. All income tax, gratuities, personal expenses, and all other expenses incurred in association with acceptance of such prize that are not specifically provided for herein, including but not limited to, gratuities, meals and any other incidental expenses, are solely the responsibility of the applicable prize winner and his or her guests. WINNER NOTIFICATION: The potential Contest Finalists will be contacted within approximately ten (10) days after the conclusion of the judging process. Finalists/Grand Prize Winners will be sent a notice in writing ("Prize Notification") by mail. Potential winners will be required to execute an Affidavit of Eligibility, a Liability Release, and where legal, a Publicity Release (the "Prize Claim Documents"). Failure to return the Prize Claim Documents by the deadline indicated in the Prize Notification, or the determination that a potential winner/Finalist (as applicable) is not eligible to receive a prize, will result in prize forfeiture. If a Contest prize is forfeited, Sponsor may award the prize to an alternate winner selected in the manner described in Section 4, above. If a Finalist is disqualified for any reason, s/he will not receive a Finalist prize, and the Contest Judges may select an alternate Finalist on the basis of the scoring in the initial judging. Any alternate winner/Finalist will be notified as described above and required to complete and return the Prize Claim Documents in accordance with the provisions above. Each winner will be issued an IRS 1099 Tax Form for the stated value of the prize in January of the year following the receipt of prize. If Sponsor so elects, a potential winner may be required to submit to a confidential background check to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Contest will not bring Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Contest as determined by Sponsor in its sole discretion. Sponsor reserves the right to disqualify a potential winner/Finalist on the basis of the findings resulting from such background check.
GENERAL CONDITIONS: By entering the Contest, each Participant agrees to abide by and be bound by these Official Rules and the decisions of the Sponsor and the independent judging organization/Contest Judges, as applicable. All such decisions shall be final, binding and non-appealable. Prizes are non-assignable and non-transferable. No prize substitutions or cash redemptions except as provided herein. Sponsor reserves the right in its sole discretion to substitute a prize or portion thereof of equal or greater value if any prize or portion thereof is unavailable for any reason. Details of prizes or portions thereof not specified herein, if any, will be determined at the sole discretion of Sponsor. Each winner shall be responsible for all federal, state and/or local income taxes incurred in association with acceptance of the prize. By participating in the Promotion, each Participant agrees that the Sponsor and its parent company, subsidiaries, franchisees, affiliated companies, promotion and advertising agencies, official judges, including the London Organizing Committee of the Olympic Games and Paralympic Games Limited (LOCOG), the International Olympic Committee (IOC) and the United States Olympic Committee (USOC); IOC and USOC (the “Promotion Entities”) shall not be responsible or liable for any losses, damages or injuries of any kind, including but not limited to those related to defamation, portrayal in a false light or privacy rights, resulting from or in connection with participation in the Contest or from acceptance, receipt, possession and/or use or misuse of a prize, or from the posting or publication of any Submission or portion thereof online or in any media. Participation in this promotion is subject to all applicable federal, state and local laws and regulations.
TRAVEL CONDITIONS: Each Finalist Prize winner must be the parent or legal guardian of the child that will be their travel companion for the Finalist Prize trip. Each Finalist Prize winner and travel companion must possess all required travel documents, including Passports and valid photo identification, as applicable. Finalist Prize winners and travel companion must comply with all hotel check-in requirements, including but not limited to the presentation of a major credit card. Finalist Prize winners, for themselves and on behalf of their child, must sign eligibility and liability release documents prior to any travel documents being released. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All airline tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes. The round trip air transportation element for any travel prize begins and ends at the point of departure (unless otherwise specified herein). Changes not permitted after tickets are issued. Sponsor reserves the right to structure travel route and select hotels in its sole discretion. Finalist Prize winners and travel companion must travel together on the same itinerary. In the event any winner or travel companion engages in behavior that (as determined by Sponsor in Sponsor's sole discretion) is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person or deemed by the Sponsor to be threatening or damaging to the Sponsor, the Sponsor reserves the right to terminate the trip early and send the Finalist Prize winners and travel companion home with no further compensation at the cost of the Finalist Prize winners. Sponsor reserves the right in its sole discretion to substitute a prize(s) of comparable value if any prize is unavailable for any reason. Details of prizes or parts thereof not specified herein are at the sole discretion of Sponsor. Tickets to the 2012 Games, whether awarded as a prize and/or are included as part of a promotion, must be accepted as awarded and are subject to all of the applicable terms and conditions prescribed to such tickets from time to time by the London Organizing Committee of the Olympic Games and Paralympic Games Limited (LOCOG), the International Olympic Committee (IOC) and the United States Olympic Committee (USOC); Such terms and conditions are contained in the Ticket License Agreement (which can be reviewed at www.tickets.london2012.com), on the back of the physical ticket (once issued) and include prohibitions against any use of the ticket in connection with any commercial promotion or contest (without the consent of the London Organizing Committee of the Olympic Games and Paralympic Games Limited (LOCOG) and the unauthorized sale of the ticket in excess of face value of the ticket. By accepting tickets as a prize and/or as part of a promotion, the holder is deemed to have accepted all of the applicable terms and conditions.
DISQUALIFICATION: It is the Participant's responsibility to ensure compliance in all respects with these Official Rules. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry processes or the operation of the Promotion; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Promotion, or to annoy, abuse, threaten or harass any other person. Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.
FORCE MAJEURE: Sponsor reserves the right, without prior notice and at any time, to terminate the Promotion, in whole or in part, or modify or suspend the Promotion in any way, if it determines, in its sole discretion, that the Promotion is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions have destroyed or severely undermined the integrity and/or feasibility of the Promotion. In the event Sponsor is prevented from continuing with the Promotion as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Sponsor's control (each a "Force Majeure" event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Promotion. If the Promotion is terminated, in whole or in part, before the designated end date, Sponsor reserves the right to select the Contest Finalists and Grand Prize Winners from among all eligible, non-suspect Submissions received as of the date/time of the event giving rise to the termination. Only the type and quantity of prizes described in these Official Rules will be awarded. Any prizes that are not duly claimed in accordance with these Official Rules will not be awarded.
INVALIDITY: These Official Rules cannot be modified or amended in any way except in a written document issued by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Promotion materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control.
LANGUAGE DISCREPANCY: In the event there is a discrepancy or inconsistency between the English language version and the Spanish language version of these Official Rules or of any Contest materials, the English version shall prevail, govern and control.
GOVERNING LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of the Participant or Sponsor in connection with the Promotion shall be governed by and construed in accordance with the internal laws of the State of Illinois without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state's laws.
ARBITRATION PROVISION: By participating in this Contest in the fifty (50) United States and D.C. Each Participant agrees that: (1) any claim, dispute, or controversy (whether in contract, tort, or otherwise) Participant may have against the Releasees arising out of, relating to, or connected in any way with the Contest, the awarding or redemption of prizes, or the determination of the scope, enforceability or applicability of this agreement to arbitrate, will be resolved exclusively by final and binding arbitration administered by American Arbitration Association ("AAA") and conducted before a sole arbitrator pursuant to the applicable Rules and Procedures established by AAA ("Rules and Procedures"); (2) this arbitration agreement is made pursuant to a transaction involving interstate commerce, and shall be governed by the Federal Arbitration Act ("FAA"), 9 U.S.C. §§ 1-16; (3) the arbitration shall be held at a location determined by AAA pursuant to the Rules and Procedures (provided such location is reasonably convenient for Participant), or at such other location as may be mutually agreed upon by the Participant and Sponsor; (4) the arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the applicable Participant may have entered into in connection with the Contest; (5) the arbitrator shall apply Illinois law consistent with the FAA and applicable statutes of limitations, and shall honor claims of privilege recognized at law; (6) there shall be no authority for any claims to be arbitrated on a class or representative basis, arbitration can decide only the Participant’s and/or Sponsor’s individual claims; the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (7) the Participant and Sponsor shall be entitled to recover punitive, incidental and/or consequential damages only to the extent permitted by law; (8) in the event that the administrative fees and deposits that must be paid to initiate arbitration against Sponsor exceed $125 USD for claims less than $10,000 or $375 for claims greater than $10,000 but less than $75,000, and the Participant is unable (or not required under the applicable Rules and Procedures) to pay any fees and deposits that exceed this amount, Sponsor agrees to pay them and/or forward them on the Participant’s behalf, subject to ultimate allocation by the arbitrator. In addition, if the Participant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the Participant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (9) with the exception of subpart (6) above, if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the Rules and Procedures established by AAA, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, subpart (6) is found to be invalid, unenforceable or illegal, then the entirety of this Arbitration Provision shall be null and void, and neither Sponsor nor Participant shall be entitled to arbitrate their dispute. WINNERS LIST: To receive an Official Winners List for the Contest, mail a self-addressed stamped envelope to: McDonald’s Happy Meal Chef Winners List Request, PO Box 25497, Rochester, NY 14625. The Winners List will be available in early June. The Winners List request must be received by August 24, 2012, and will be fulfilled following the awarding of prizes.
